These Terms & Conditions (“Terms”) govern your access to and use of the Trust Habit website, platform, services, and related offerings.
By accessing or using Trust Habit, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our services.
1. Definitions
For the purposes of these Terms:
“Platform” refers to the Trust Habit cybersecurity awareness, phishing simulation, and training system.
“Customer” refers to any organization, company, institution, or individual authorized to use the Platform.
“Users” refers to administrators, employees, contractors, or other authorized individuals who access or use the Platform.
2. Use of Services
Trust Habit grants Customers a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform during the applicable subscription period.
Customers may use the Platform solely for legitimate cybersecurity awareness, phishing simulation, security assessment, and training purposes.
3. Customer Obligations
Customers agree to:
- Provide accurate and current information
- Maintain the security of account credentials
- Use the Platform in compliance with applicable laws
- Ensure proper authorization for employee data uploads
- Prevent unauthorized access to the Platform
- Promptly notify Trust Habit of any suspected security incidents involving their accounts
Customers remain responsible for all activities conducted through their accounts.
4. Acceptable Use
Customers shall not:
- Use the Platform for unlawful or fraudulent activities
- Conduct phishing campaigns against unauthorized individuals or organizations
- Attempt to compromise, disrupt, or gain unauthorized access to the Platform
- Reverse engineer, decompile, or attempt to extract source code from the Platform
- Distribute malware, malicious code, or harmful content through the Platform
- Interfere with the availability, performance, or security of the services
Trust Habit reserves the right to suspend or terminate accounts that violate these provisions.
5. Intellectual Property
All software, content, reports, methodologies, designs, trademarks, branding, documentation, and intellectual property associated with Trust Habit remain the exclusive property of Trust Habit and its licensors.
No ownership rights are transferred to Customers through the use of the Platform.
6. Customer Data
Customers retain ownership of all data uploaded to the Platform.
Customers grant Trust Habit a limited right to process, store, and use such data solely for the purpose of providing, maintaining, securing, and improving the services.
Trust Habit will not sell customer data to third parties.
7. Service Availability
Trust Habit strives to provide reliable and uninterrupted service; however, we do not guarantee that the Platform will always be available, error-free, or uninterrupted.
Scheduled maintenance, software updates, security enhancements, and unforeseen technical issues may occasionally impact service availability.
8. Security
Trust Habit implements commercially reasonable technical and organizational measures designed to protect customer information and maintain Platform security.
Customers are responsible for:
- Maintaining the confidentiality of account credentials
- Managing user access permissions
- Implementing appropriate internal security controls
- Monitoring activity within their organization
9. Subscription and Fees
Certain services may require payment of subscription or licensing fees.
Unless otherwise agreed in writing:
- All fees are non-refundable
- Subscription terms are governed by the applicable service agreement or order form
- Failure to make timely payments may result in suspension or termination of services
- Trust Habit reserves the right to modify pricing for future subscription periods
10. Disclaimer of Warranties
The Platform and services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Trust Habit disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of information
- Uninterrupted or error-free operation
11. Limitation of Liability
To the fullest extent permitted by applicable law, Trust Habit shall not be liable for:
- Indirect damages
- Incidental damages
- Consequential damages
- Special damages
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of goodwill
- Data loss caused by customer actions or third-party events
Trust Habit’s total cumulative liability arising from or related to the services shall not exceed the amount paid by the Customer to Trust Habit during the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
Customers agree to indemnify, defend, and hold harmless Trust Habit, its affiliates, officers, directors, employees, contractors, and partners from any claims, liabilities, damages, losses, costs, or expenses arising from:
- Misuse of the Platform
- Violation of these Terms
- Unauthorized phishing campaigns
- Breach of applicable laws or regulations
- Infringement of third-party rights
13. Termination
Trust Habit may suspend or terminate access to the Platform if:
- These Terms are violated
- Subscription fees remain unpaid
- Continued use creates legal, regulatory, or security risks
- Required information provided by the Customer is inaccurate or misleading
Upon termination, access to the Platform may be revoked and customer data may be deleted in accordance with applicable retention policies.
14. Confidentiality
Both parties agree to protect and maintain the confidentiality of non-public, proprietary, or confidential information disclosed during the course of the business relationship.
Neither party shall disclose such information to third parties except as required by law or as necessary to perform obligations under these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
16. Modifications
Trust Habit reserves the right to modify or update these Terms at any time.
Updated versions will become effective upon publication on our website. Continued use of the Platform after any updates constitutes acceptance of the revised Terms.
